These Terms of Service (“Terms”) govern your use of the CodeBlueCoach mobile application and website (together, the “Service”), operated by CodeBlueCoach (“we”, “us”). By downloading or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Intended users
The Service is intended exclusively for trained healthcare professionals — licensed clinicians, ACLS/PALS-trained providers, emergency personnel, and medical trainees acting under appropriate supervision. If you are not a trained healthcare professional, do not use the Service in connection with patient care.
2. Not a medical device; no medical advice
CodeBlueCoach is a clinical workflow aid and reference tool. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or condition. The Service provides reference material based on published resuscitation algorithms, timers, and documentation tools; it does not provide medical advice and cannot account for the circumstances of any individual patient.
All clinical decisions must be made by qualified healthcare professionals exercising independent judgment. Your institution’s protocols and current published resuscitation guidelines always take precedence over anything shown in the Service.
3. AI-generated content
The Service can generate draft documentation (“AI notes”) from your event log using a generative AI model. You acknowledge and agree that:
- AI notes are drafts only. Accuracy, completeness, and clinical appropriateness are not guaranteed, and generative models can produce errors or omissions.
- A qualified clinician must review, verify, and edit any AI note before it is used in a medical record or for any clinical, legal, or billing purpose. You are solely responsible for the final content of any documentation you create using the Service.
- You must not rely on AI notes for clinical decision-making.
- You must not enter patient names, record numbers, or other identifying information into the Service. AI note generation is designed to work only with de-identified event data (see our Privacy Policy).
4. License and acceptable use
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You agree not to: copy, modify, distribute, sell, or lease any part of the Service; reverse engineer or attempt to extract its source code except where permitted by law; use the Service in any unlawful manner; or use it in any way that could endanger patients.
5. Intellectual property
The Service, including its design, software, and content, is owned by CodeBlueCoach and protected by applicable intellectual property laws. Resuscitation algorithms referenced by the Service are based on published guidelines of professional bodies (including the American Heart Association) and are presented for professional reference; no affiliation with or endorsement by those bodies is implied.
6. Third-party services
AI note generation is processed via Google Cloud services (see our Privacy Policy). The Service is distributed through the Apple App Store and Google Play, whose own terms also apply to your download and use of the app. We are not responsible for third-party services.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETE, OR THAT ITS CONTENT REFLECTS THE MOST CURRENT GUIDELINES AT ALL TIMES.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CODEBLUECOACH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE — INCLUDING ANY CLINICAL DECISION MADE OR DOCUMENTATION CREATED USING THE SERVICE. YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SERVICE IN CLINICAL SETTINGS.
9. Indemnification
You agree to indemnify and hold harmless CodeBlueCoach from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
10. Changes to the Service and these Terms
We may modify or discontinue the Service at any time. We may update these Terms; the current version will always be posted here with its effective date, and continued use of the Service after changes take effect constitutes acceptance.
11. Governing law and severability
These Terms are governed by the laws of the United States and the state in which CodeBlueCoach operates, without regard to conflict-of-law principles. If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect.
